Blurred Lines

 

The killing of George Floyd is just a recent example of the racist and hateful treatment that people of color continue to receive in this country.  This tragedy has led to displays of social activism in the streets, on social media, and in the workplace.

 

The line between one’s work and private life has become more blurred than ever, due to the COVID-19 pandemic causing employees to work from home. While most conduct related to recent topics will hopefully contribute to a more inclusive America, some employee conduct may impact productivity, morale, or other employees’ civil rights.

 

Employers need to know that the NLRA prohibits retaliation against employees. Rules that interfere with workers’ rights to share information about working conditions remain unlawful.

 

Depending on the type of conduct, an employer must determine whether it is protected before disciplining employees for their off-duty activities.

How a company responds to employees’  behavior can send a message to its employees, recruits, customers, and the public.

 

Although there are legal limitations on an employer’s ability to address distasteful behavior by his or her employees, affirming commitment to workplace diversity and inclusion can positively impact productivity and employee morale.
